What a Las Vegas personal injury lawyer can review

Personal injury law covers harm caused by someone else's negligence. That can be a crash, a fall on unsafe property, or a workplace incident that also involves a third party. The label is broad. The work is specific: prove what happened, document the injury, find coverage, and answer fault arguments before Nevada's filing deadline runs.

A personal injury claim is not a form you fill out and hope the insurer treats fairly. Adjusters work for the company that may have to pay. They can question whether you were hurt, whether treatment was needed, and how much of the crash or fall was your fault. Counsel's job is to gather the record and present the claim while you focus on medical care.

Truck files often involve a commercial policy, a motor-carrier file, and more than one company that may share responsibility. Slip-and-fall files turn on notice: whether the property owner knew or should have known about a dangerous condition and failed to fix it or warn visitors. Workplace injuries can involve a workers' compensation claim, a third-party negligence claim against someone other than the employer, or both. None of those paths is automatic. How a Nevada personal injury claim usually moves

Most injury files follow a similar path, whether the harm came from a sedan, a motorcycle, a commercial truck, a wet floor, or a job-site incident.

  1. Get medical care and keep the records. Treatment protects your health and creates the chart that shows what was injured and when.
  2. Report the event to the right place. After a crash, that is often the police. After a fall, it may be the property owner or manager. After a work incident, report it to the employer and keep a copy.
  3. Save photos, names, and damaged property. Video and witness memories fade. Vehicles get repaired. Floors get cleaned.
  4. Identify insurance that may apply. That can include the other party's liability policy, your own uninsured or underinsured motorist coverage after a crash, a property policy, or an employer policy. The insurance glossary explains common auto terms that show up after a vehicle collision.
  5. Wait to value the claim until the medical picture is clearer. Signing a release too early can close the file on future care you still need.
  6. Negotiate or file suit inside the deadline. Many Nevada personal-injury lawsuits must be filed within two years of the injury under NRS 11.190. Some matters have different rules. Waiting is how valid claims expire.

The two-year clock. NRS 11.190 generally gives two years to file a personal-injury lawsuit. Missing that window can end the case even if the facts were strong. Evidence also disappears long before the statute runs. Call early if you are close to a deadline or if a government entity may be involved.

Shared fault. Nevada uses modified comparative negligence with a 51% bar under NRS 41.141. You can still recover if you were 50% or less at fault. The award is reduced by your share. If you are found more than 50% responsible, recovery can be barred. Insurers know this rule and often argue you were more at fault than the record supports.

Auto minimums when a vehicle is involved. NRS 485.3091 sets Nevada's minimum liability limits at $25,000 per person, $50,000 per accident, and $20,000 for property damage. Serious injuries can exceed those numbers quickly. That is why your own uninsured or underinsured motorist coverage can matter after a crash. Truck, slip-and-fall, and workplace files may involve different policies. The statute still matters for any motor-vehicle piece of the case.
